Court awards 3 years imprisonment in attempt to kidnapping case

JAMMU, Jan 29: Principal Sessions Judge Rajouri Jaffer Hussain Beigh today awarded three years rigorous imprisonment to Amit Kumar, Ajay Kumar and Sanjeev Kumar facing trial under sections 457 and 366-511 read with section 34 RPC.
The prosecution case in brief is that the complainant, the prosecutrix lodged a written report with Police Station Nowshera against the accused Amit Kumar, Ajay Kumar and Sanjeev Kumar with the averments that she is the resident of Handan and is working as a teacher in Private Academy. Accused No1 to 3 used to tease her whenever she was returning from the school. During the night intervening between 1st and 2nd of November 2010 at about 11 p.m when she had gone to the house of her aunt, all the accused persons with criminal intention trespassed into the lawn of her aunt and started knocking the door by striking on it as a result of which the bolt from inside the door was broken and all the accused persons started abducting her by holding her arms, legs and breast. When she raised hue and cry all these accused persons started causing injuries upon her by fists and kicks. The accused also tried to gag her mouth and during this struggle the accused dragged her out of the gate of the house. Her aunt and grand-mother raised hue and cry as a result of which villagers came on spot and rescued her from the clutches of the accused, otherwise, the accused would have abducted her and would have outraged her modesty. The villagers caught the accused Amit Kumar on spot and also took the motorcycle in their possession. The accused have committed the offences u/s 458,354,109 RPC, action under law be taken against them. On this application FIR No.168/2010 for the offences u/s 458,354,366,511 RPC stood registered in Police Station Nowshera.
Principal Sessions Judge Rajouri Jaffer Hussain Beigh after hearing both the sides observed that the trial in this case has taken about nine years and the accused persons have their families. For these reasons I sentence each of the accused, namely, Amit Kumar, Ajay Kumar and Sanjeev Kumar to undergo rigorous imprisonment for three years and to pay a fine of Rs 10,000 for commission of offence under sections 366/511 RPC. In default of payment of fine the accused persons shall further undergo imprisonment of like nature for 6 months; to undergo rigorous imprisonment for two years and to pay a fine of Rs 8,000 for commission of offence under sections 457 RPC.
In default of payment of fine the accused persons shall further undergo imprisonment of like nature for 4 months; further to undergo rigorous imprisonment for one year and to pay a fine of Rs.5,000 for commission of offence under sections 354 RPC. In default of payment of fine the accused persons shall further undergo imprisonment of like nature for 2 months. All the three sentences of rigorous imprisonment shall run concurrently. JNF
