Former Sagipora-Sopore Patwari convicted in graft case

Srinagar, Feb 27: Ghulam Mohammad Kumar resident of Behrampora-Banipora Tehsil Sopore Baramulla, the then Patwari Halqa Sagipora Sopore was convicted in case FIR No 39/2006 of PS VoK ( Now ACB) by Naseer Ahmad Dar, 1st Additional District & Session Judge, Baramulla (Special Judge Anti Corruption Baramulla-Kupwara-Bandipora) of offences punishable u/s 5(1)d r/w 5(2) JK P C Act and 161 RPC and was sentenced for two years simple imprisonment under each offences punishable u/s 5 (1)d r/w 5(2) JK P C Act and 161 RPC and fine of Rs 10,000/- under each offence.
The judge ruled that in default of payment of the fine, the accused shall undergo further imprisonment of two months under each offence. The judgment further read that the sentences shall run concurrently and the period already under gone shall be set off.
A written complaint was lodged by one namely, Khurshid Ahmad resident of Sagipora, alleging there in that he had purchased 14 Marlas of land and obtained agreement to sell in this regard. He had further alleged that he approached the accused for making necessary entries in the revenue record who demanded Rs 5,000/- as bribe to make the necessary entries in the revenue record. An amount of Rs 2,500/- as bribe was settled to be paid on 10/10/2006.
Immediately after registration of the case, the investigation of the case was taken up. A trap team was constituted. Currency notes produced by the complainant were noted in presence of an independent witness and other witnesses. The currency notes produced by the complainant were treated with phenolphthalein and handed over to the complainant for paying to the accused as bribe on his demand.
The complainant and the independent witness contacted the accused. The accused on seeing the complainant came out of office. The complainant handed over the agreement to sell to the accused public servant outside the office. The accused after going through the agreement demanded and accepted the bribe money. The trap team immediately rushed on the spot and recovered the tainted money from the accused. The accused was arrested on spot and investigation was further taken up.
The final report of the case was submitted before the Court for judicial determination. Immediately after pronouncing the sentence, the accused was lodged in sub jail Baramulla by the orders of Special Judge Anti Corruption Baramulla-Kupwara-Bandipora.
