High Court quashes PSA detention order of HM militant

Jammu, Mar 6: In a Habeas Corpus petition moved by Advocate Faheem Shokat Butt, Hon’ble Justice Ali Mohammad Magrey of J&K High Court today quashed detention order No. 103/PSA of 2018 dated 14.11.20118 passed by District Magistrate Kishtwar Angrez Singh Rana whereby a dreaded militant of Hizbul Mujahidin outfit namely Sajjad Hussain Mir @ Rizwan S/o Late Noor Hussain Mir, R/o Village Thachana Dachhan, Tehsil and District Kishtwar was detained under J&K Public Safety Act.
As per the details available with Early Times, it is alleged in the detention order that the detenue is a top rank militant of HM outfit and has started waging war against the Govt. of J&K with sole motive to segregate the State from Union of India and disturbing the public peace and tranquillity by using criminal force and that also effect the erstwhile district Doda including Kishtwar and is reported to have recruited various youths of district Kishtwar in militant organization during active militancy and has created terror among public at large.
It is also alleged that the detenue is involved in number of murder cases and participated in the mischievous activities, Anti India propaganda, instigation and motivating the youth and lured them into the fold of militancy of HM group.
The High Court after hearing the counsel for the State and Mr. Faheem Shokat Butt Advocate appearing for the detenue Sajjad Hussain Mir quashed the detention orderby referring various judgments of Hon’ble Supreme Court and held that since the documents, statements and other material referred to or relied upon in the grounds of detention by the detaining authority in arriving at its substantive satisfaction has not been supplied to the detenue so as to afford him earliest opportunity of making representation against the detention. As a consequence of quashment of detention order the High Court directed the release of detenue forthwith. The detenue was lodged in Kathua jail from where he will be released after court issued formal order in this regard.
