Domicile will neither change Demography nor deny jobs to local youth : Brig Gupta

Jammu, Apr 5: “Not sooner than the ink had dried on the two latest promulgations of the Ministry of Home Affairs (MHA) with relation to amendment of the J&K Civil Services (Decentralisation and Recruitment Act- (Act No XVI of 2010) the Kashmir-centric political leadership led by Omar Abdullah and the leaders of its second string namely Congress launched a vilification campaign against the Government accusing it of intent to change demography of the Union Territory” said Brig Anil Gupta and added that this deliberate misinformation campaign was based on the term “Domicile” replacing “permanent resident of the state” which was necessitated due to abrogation of discriminatory Article 35A.
A new sub section 3A titled “Domicile for purposes of appointment to any service in Union Territory of Jammu & Kashmir” implying that domicile as defined in the sub section shall be applicable only for the state government jobs as defined in the Act of 2010 was inserted, asserted Brig Gupta. There was instant criticism stating that the promulgation is ill-timed and the government was accused of doing it deliberately when there was lockdown due to coronavirus, rued Brig Gupta. “The same very leadership was accusing the government of not starting the process to fill 50000 government jobs as was promised after abrogation of 370. The government with the good intention of rolling out these jobs for the unemployed youth had also earmarked 2000 crore in the UT’s budget for current FY. This is to ensure that the process of recruitment is not delayed due to coronavirus and is completed within the FY, which is a gigantic exercise, the government worked over time to promulgate the notification without which the process could not have begun. Yet the government is being accused on the ground which is self-perceived and fractious,” stated Brig Gupta.
Who will benefit from the new rule? It would be the wards of West Pakistan refugees, Balmikis,Gorkhas , Punjabis and migrant labour. All except the migrant labour are the inhabitants of the state for periods much longer than 15 years and had been unjustifiably denied the basic facilities including jobs under the garb of 35A for the reasons well known to Kashmiri leaders. They will neither change the demography nor snatch the jobs of local youth as they are very much part of our existing eco-system, asserted Brig Gupta. “I challenge the local Congress leadership to openly state that these categories should be denied government jobs.” As far as migrant labour is concerned their number eligible for jobs may not be even a few hundred when the total jobs at stake are 50,000 while the total jobs amount to 4.5 lakh. The objection to including the wards of All India Services and other Central government departments is also not justified as the Act states that they “shall have served for 10 years.” It implies that it would not be effective retrospectively. In other words, it wards of those serving now. Again, not even a hundred would be eligible, clarified Brig Gupta.
“I therefore appeal to the people to not to get carried away by this motivated, misinformation campaign. Their anger and opposition has nothing to do with the interest of the local youth but to build a narrative for restoration of 370 and 35A in a different avtar,” asserted Brig Gupta.
