END RESERVATION FOR PROMOTION OF TALENT
6/30/2020 12:04:07 AM

Prof. Y.P. Sanson

The preamble to the constitution says, “We the people of India having solemnly resolved to constitute India a Sovereign Socialist Secular Democratic Republic and to secure to all its citizens- Justice, Social, Economic and political; liberty of thought, expression, belief, faith and worship. Equality of status and of opportunity and to promote among them all.
The most important Fundamental Right which is regarded as one of the element of the basic structure of the constitution, which the parliament cannot amend is the right to equality, which has been incorporated in articles 14, 15, 16 and 17.
Article 14 directs that the state shall not deny equality and equal protection of the laws to any person. Article 15 prohibits discrimination by the State against any citizen only on the grounds of caste, religion, race, sex and place of birth or any of them. When we are all children of India and therefore brothers; there is no reason for dividing us on the basis of caste and feeling of high and low. The provision for temporary reservation for initial 10 years was incorporated in Article 15(4) and 16(4) in favour of backward classes including dalits has given raise to hatred and social tension. Reservation is not a fundamental right of any caste or class. It was simply a compensation to them to raise their economic and social standards.
Economic standard of a family is directly or indirectly related to social status. These provisions are part of the scheme to ensure equality, among all the citizens of India. See what our political parties have been doing despite the evils of caste in social matters, the political parties have been considering the caste which is a social evil and liability, as their political asset and capital. As a result, the evil of injecting caste poison into politics, crept into our body politics. Some major reserved castes have monopolize reservation for their personal interests and benefits ignoring the deserving of their own castes.
The political leaders are responsible for the continuation of caste based reservation without any reasonable review, in the country. It is moral duty of the government to uphold the principles of equality, justice, liberty and dignity to all.
Since 1950, General Category Peoples are facing discrimination in the name of social justice and past injustices. It could not be allowed to continue till infinity. Caste based reservation be ended and special arrangement be made for the welfare of all economically and educationally backward families. Majority cannot be allowed to continue to live without their fundamental rights and face subjugation.
Though general category people are being subjected to grave injustice during last 70 long years and even now it is continuing to some extent, they have not retaliated and have done nothing which is injurious to the unity and integrity of Nation. The recent Court verdicts have made it clear that reservation is not a fundamental right and cannot be kept on without review. It was a temporary and transitional. It has no relevance today and should disappear from the constitution.
Transitional period has been long enough. Reservation is an obstacle to the Indian spirit of secularism; an irritant for the nation. Let us chant the matra:
Let almighty God protect us together
Let us share work together
Let us acquire knowledge together
Let us not hate each other.
