Police produces chargesheet against Yaseen Malik in unlawful activities case

BARAMULLA, July 2: Police on Thursday produced chargesheet against accused Mohammad Yaseen Malik in respect of two cases registered against FIRs 260/2008 and 109/ 2010 under section 13 ULA(P) at Police Station Sumbal, before Addition District & Session Judge Baramulla, Sanjay Parihar through virtual mode.
Accused Mohammad Yaseen Malik, son of Gh Qadir Malik, resident of Maisuma Srinagar was booked by Sumbal police in two FIRs registered in 2008 and 2010 for organizing unlawful activities at Sumbal town there by threatening cessation of territory of India and organized crowds to raise and threatened integrity and sovereignty of the country.
Chargesheet was produced against accused Mohammad Yaseen Malik Ld APP. Before filing charge sheet on 30.6.2020, prosecution has moved an application for issuance of production warrant for production of accused by way of video conferencing for filing of charge sheet, who is presently lodged at Tihar Central Jail No 7, New Delhi and could not be physically produced due to prevailing situation.
Presence of accused Mohmmad Yasin Malik was ensured by court by way of video conference today, who has been identified by Assistant Superintendent Jail No 7 Tihar Delhi.
Accused has been informed and made aware that charge sheets have been lodged against him in respect of two cases under section 13 ULA (P) in which sanction for prosecution had been already given, Copies of the charge sheet have been made available to accused through email on mail of Superintendent Jail No 7 Tihar who he has acknowledged its receipt which is also corroborated from the repot of System Officer, District Court Baramulla.
Court made accused aware that he has right to engage counsel of his choice to which he replied that he would be arguing himself. Court observed that since accused has been challenged for commission of special offence falling us 13 of ULA(P)Act, so in order to afford him due legal aid and opportunity of being of heard and given the fact that he is lodged outside UT of J&K .
Therefore court directed Secretary DLSA Baramulla to provide a suitable penal lawyer for appearance on behalf of accused so as to enable him to have a fair trial and the case was listed for next hearing of arguments on charge discharge on 21.7.2020.
