Court awards 5 years imprisonment to govt employee for producing fake document

JAMMU, July 7: 2nd Additional Sessions Judge Srinagar Vijay Sing Manhas awarded Abdul Rashid Bhat who is working as Mulberry guard in Sericulture Department has produced a fake matriculation certificate for being promoted to the post of Bush Technician.
2nd Additional Sessions Judge Srinagar Vijay Singh Manhas after hearing both the sides observed that prosecution has proved its case beyond all reasonable doubts that the accused person has used fake and fabricated matriculation certificate/diploma, while also facilitating the fake and fabricated verification report in the office of his employer Sericulture Department for seeking his promotion as Bush Technician from the post held as Mulberry Guard as such, the accused is held guilty and convicted under section 468 RPC. Further it has been established by the prosecution also beyond all reasonable doubts that by using the fake and fabricated matriculation certificate/diploma bearing No.530996 of year 1987 as genuine vis-a-vis the fake and fabricated BOSE VERIFICATION no.509-B dated 28-10-2006, as such, accused is held guilty and convicted under section 471 RPC. Since it is also established that the accused person has not produced the fake matriculation certificate/diploma on being asked to do by the Investigating Officer, as such, the accused is held guilty and convicted under section 201 RPC and awarded imprisonment for a period of two years along with a fine of rupees two thousand (Rs 2000) for offence u/s 468 RPC, imprisonment for a period of 2 years and a fine of rupees two thousand (Rs 2000) for offence u/s 471 and one year and a fine of one thousand (Rs 1000) for commission of offence u/s 201 RPC. In default in payment of fine of rupees five thousand (Rs.5,000), the convict shall has to suffer a imprisonment for a further period of six months. All the sentences awarded with regard to the offences u/ss 468, 471 and 201 RPC shall run concurrently. JNF
