While passing direction CJM Reasi Amarjeet Singh Langeh observed that the crux of allegations outlined by complainant against accused who is stated to have been presently posted as DySP (HQ), Reasi – is that on 29.06.2020 at about 06:00 PM while complainant was proceeding towards Katra on motorcycle, he was intercepted at Thapa Chowk, Reasi by accused and other police officials; that when he (complainant) failed to show documents to accused, later started using abusive language and displayed absurd and obnoxious behaviour; that his motorcycle was subsequently seized; that when complainant sought time to produce documents, accused instead of listening to him – used filthy language and forcibly pushed him down and started giving physical thrashing with fists and blows and accused also snatched his mobile phone and hurled threat of life to him should he (complainant) tries to approach court; that accused also passed defamatory and derogatory remarks as are penpictured in the concluding part of para 2; that accused had no right whatsoever to use criminal force against him as also to snatch his mobile phone and use derogatory language etc. etc. Complainant prays that accused be proceeded under sections 323, 500, 504 & 506 of IPC and process be issued against him so that not only accused can be put on trial but he be given chance to vindicate himself in accordance with procedure established by law before this court.
