Chanchal Singh, sons refute allegations of grabbing Cremation Ground land

JAMMU, July 12: It is with reference to the news item title “Alleged encroachment of cremation ground land at Lower Barnai hurts sentiments of people” published on 11/7/2020 in Early Times’ edition wherein other party of Chanchal Singh and his sons
Refuting the allegations and news items published in a section of the media with regard to grabbing of some land belonging to the Cremation Ground (Shamshan Ghat) at Lower Barnai, the party facing the accusations said that the claims made by the other group are not factually correct.
Denying the allegations leveled by some individuals, Chanchal Singh and his sons said that it is baseless that they have grabbed land of Shamashan Ghat at Lower Barnai.
To substantiate their counter arguments, Chanchal Singh and his sons, who are facing the allegations of land grabbing, produced some documents which reveal another side of the story. They alleged that the person, one of them who leveled baseless allegations, is the main person, who is actually grabbing land of Shamshan Ghat as well as the land belonging to them, adding that he has criminal records and there are many cases which stand registered at Police Station Doman.
“He has installed iron bar in our land Khasra No. 100 forcibly, he is filling Ramkund (Choi) situated in Khasra No. 99 (which was used by the inhabitants of village Barnai/Neter Kathen for pouring ashes/ remains of the dead body after cremation) and crossed over from Khasra No. 98 to Khasra No. 100 which have proved by a commission constituted by the Divisional Bench of High Court of Jammu vide order dated 28/08/2017.
They further said that he had filed High Court of Jammu OWP No. 1083/ 2014 dated 18/03/2016 on behalf of Panchayat Halqa Barnai but Divisional Bench of High Court of J&K at Jammu order No LPAOW No. 12/2016, wherein the order for status quo was issued.
“Letter No DCJ/Legal/342 dated 19/08/2016, vide which directions have been issued by the ADC Jammu to maintain status quo, referring to the above Court orders. Advocate Monika Kohli letter dated 15/05/2017, where said senior advocate was detailed as Commissioner to visit the spot after giving notice to the parties and shall submit the report before the High Court at Jammu,” they informed.
Field report of the Commissioner, detailed by Divisional Bench of High Court a Jammu which prove that iron bars have been inserted in Khasra No. 100 and it is clearly mentioned in the report that present demarcation with iron bars is falling in Khasra No. 100 whereas the Shamshan Ghat stands in Khasra no. 98, they said.
“Report of Tehsildar Jammu North dated 15/07/2017, clearly justify that iron poles were never inserted by the revenue authority, which clearly speaks about the volume of reporters, reporting false stories and misleading the various authorities at various levels and dancing every authorities on their tunes, hence such persons are required to dealt with, strictly for misleading such senior authorities,” they said.
They said that Divisional Bench of High Court Jammu CPLAOW No. 12/2016, where orders passed by single Judge on 18/03/2016 on the writ petition filed by the inhabitants of panchayat halqa Barnai through this individual was quashed and set aside. Divisional Bench of High Court at Jammu CPLA No. 29/2016 dated 9/11/2017 which clearly reflect the applicant to seek any remedy, if he has still any grievance which may be available to him in law.
