Udhampur court rejects bail in murder case

UDHAMPUR, Aug 10: Principal Sessions Judge M L Manhas rejected bail application of one Sanjay Kumar who is facing trial in murder case.
Rejecting the bail application, Principal Sessions Judge Udhampur, Manhas observed that in the present case, there is no dispute that the accused has been charged for the offences punishable under Sections 302 RPC and also trial is going on.
According to case history accused is facing trial before the Court for the allegations, that “on 15.01.2017, he took the deceased form TCP Udhampur along with him in a hotel where they both consumed 2 pouches of country made liquor. From there accused took the deceased in his room in Ward No. 1 Shajalta Udhampur and after quarrel between the two at night and with his criminal intention the accused inflicted danda blows on the head of the deceased and killed him on spot.
The Court said only 10 witnesses till date have examined by the prosecution out of 24 witnesses and witnesses produced by prosecution till date have not squarely exonerated the accused/applicant herein.
Therefore, in view of the given facts and circumstances the bail application appears to be premature. Consequently in view of the above stated reasons I do not think accused person deserve discretion of this court at this stage. The offence alleged to have been committed by the accused is heinous and entail punishment of death or life sentence. Unless and until all the important witnesses are examined in the case, this court cannot come to the conclusion that there appears no reasonable ground for believing that accused is guilty of an offence punishable with death or imprisonment for life, the judge observed.
