Court awards rigorous life imprisonment in murder case

RAJOURI, Aug 13: Principal Sessions Judge Rajouri Jaffer Hussain Beigh today awarded rigorous life imprisonment to Sunnit Singh for murdering his neighbor over old enmity.
According to the police case, the accused Sunnit Singh committed murder of Abdul Gani on 30-04-2009. The accused had enticed Shakeela Begum, daughter of Sraj Din for having illicit relationship and the deceased, the maternal cousin of Shakeela forbade the accused for such activities. On the day of occurrence when the deceased was packing his baggage to go to Kashmir, the accused at about 6.30 PM came in the land and called the deceased to listen to him. He was in his land at that time situated adjacent to the land of the deceased. On the call of the accused, the deceased went to the accused along with two sons namely Mohd Ishaq and Mumtaz Ali. As soon as the accused saw the deceased, the accused gave a Tokka blow on the neck of the deceased. Police registered a case and after completion of investigation challan was presented.
Principal Sessions Judge Rajouri Jaffer Hussain Beigh after hearing Public Prosecutor Shaheen Ahmed Khan for the UT whereas Adv Inderjeet Sharma for the accused person observed that circumstance and the manner of committing the crime should be such that it pricks the judicial conscience of the Court to the extent that the only and inevitable conclusion should be awarding of death penalty which in my opinion does not arise in the instant case though the act of the accused for committing murder of the deceased by amputating his head from the body was barbaric. For these reasons I find that the case does not fall within the category of ‘rarest of rare case’. I, accordingly, sentence the accused Sunnit Singh to undergo rigorous imprisonment for life and also to pay a fine of Rs 15,000 for the commission of offence under section 302 RPC and in default of payment of fine he shall further undergo imprisonment of like nature for two years. The accused be lodged in Central Jail Kote Bhalwal Jammu for undergoing the above said sentences imposed upon him. JNF
