Court denies bail to rape accused

JAMMU, Sep 4 (JNF) Principal Sessions Judge Reasi Kamlesh Pandit rejected the bail application of one Akshit Sharma son of Davinder Sharma against whom Reasi Police have register 103/2019 U/Ss.:- 366/376/509/109 RPC & 66-E IT Act.
The objections have also been filed by the prosecution in which strong exception has been taken by the prosecution by pleading that the accused used to commit rape repeatedly on the complainant/prosecutrix, under the garb of nude pictures of prosecutrix in his mobile phone which were earlier clicked in his shop by administering some intoxicating drug mixed in a glass of water. Thereafter, on 25.04.2019 the prosecutrix was called by the accused at Shalimar Chowk Jammu, she saw accused accompanied by one Ashok Singh son of Rashpaul.
Both of them blackmailed her and kidnapped her. She was taken to Court Complex Jammu. The accused/applicant herein Akshit Sharma threatened her to perform marriage with him otherwise her nude images would be made viral on internet. In order to save her career, she signed the marriage agreement. The accused also took her to Arya Samaj Mandir and forcefully performed marriage with her. When the prosecutrix came to know that her nude videos and pictures have turned viral on the internet she filed the instant case FIR No.103/2019 for offences U/S 366/376/509/109 RPC read with section 66-E IT Act at Police Station Reasi.
Principal Sessions Judge Reasi, Kamlesh Pandit while rejecting the bail application observed that the offence committed by the accused person is not only an onslaught on an individual person but on the whole society at large. A sexual assault disturbs the psychological and emotional life of the victim. Therefore, a solemn duty is cast on the courts while exercising discretion in balancing individual liberty and the interest of the whole society at large. JNF
