JAMMU, Sept 7: Principal Sessions Judge Jammu Sanjeev Gupta dismissed the challan in a murder case after eight years and acquitted Mohd Younis Khan from the charges leveled against him. The prosecution case is that on 19.05.2012, Zeenat Firdous along with accused Mohd Younis Khan, approached Police Station Domana, where Zeenat Firdous stated before Arun Jamwal (PW-2), the then SHO P/S Domana, that the accused, is her first husband and after divorce with him she had contracted marriage with Ghulam Rasool (hereinafter called deceased), who is missing for the last one year and the accused wants to disclose something in connection with the missing of deceased. Thereafter, accused confessed before PW-2 that he was having an enmity with the deceased with regard to money due to which in the month of September, 2011, in the evening, he had committed the murder of deceased at a secluded place near village “Kot” and buried his body after digging a pit. From the statement made by the accused, offence U/S 302 RPC was made out against the accused. Principal Sessions Judge Jammu Sanjeev Gupta after hearing Adv AR Khan for the accused person observed that Considering the totality of the facts and evidence, in my opinion, the circumstances relied upon by the prosecution are not established by convincing evidence and they do not form a complete chain pointing to the guilt of the accused and therefore, prosecution has failed to establish the guilt of the accused beyond reasonable doubt. In view of the discussion made above and in the facts and circumstances of the case, the prosecution has failed to prove its charge against the accused U/Ss 302/201 RPC, as such, prosecution case is dismissed and accused is acquitted of the charge.
