Accused driver gets bail, Court releases vehicle

JAMMU, Sept 20: In a case of illegal transportation of liquor in an ambulance of District Hospital Kishtwar, the police granted bail to the accused driver since the offence under 48 (a) Excise Act is bailable by police.
Meanwhile, the accused driver Kulwant son of Munshi Ram of Semna Colony Kishtwar also moved an application for the release of the seized ambulance, which was released by the Court. Kulwant was arrested by the Thathri police on September 18 in case FIR No 76/2020 U/S 48 (a) Excise Act. Advocate Amir Irshad Mughal, Counsel of the accused moved an application before the Court of District Mobile Magistrate Traffic Doda through virtual mode for release of ambulance which was seized by the police after the accused driver was caught ferrying the liquor in the vehicle. After hearing the defence counsel and Public Prosecutor, the judge issued a detailed order ordering the release of vehicle (Ambulance) bearing registration No JK17-3791 in favour of Medical Superintendent District Hospital Kishtwar or duly authorized representative of Medical Superintendent District Hospital Kishtwar on Supurdnama after proper verification of identity particulars and after retaining original Driving License of the driver. The Court ordered the release of the vehicle on the condition that Supardar shall not dispose off the vehicle, change the colour of the vehicle, nature or ownership of the vehicle beside will produce the vehicle as and when required before the investigating officer or Court.
