Court awards seven years rigorous imprisonment in rape case

JAMMU, Sept 26: Additional Sessions Judge Udhampur S R Gandhi today awarded seven years rigorous imprisonment to Surinder Singh R/o Kotli Jija Udhampur facing trial in rape case.
The police case is that on 7-12-2011, the prosecutrix (name withheld) made a written report in Police Station alleging that the accused called her and when she met him, he raped her and also threatened her. The accused asked her for marriage and thereafter she had physical relations with him.
She was working in an office and the accused used to come to her for 8/9 days and had sexual intercourse with her with the promise to marry her. By act of the accused she became pregnant thrice. She was given medicines by the accused for termination of the pregnancy. It is also alleged that the accused also threatened her to cause harm to her family as well. It is alleged that the accused raped her. On the basis of this report FIR No. 211/2011 under Section 376 RPC was registered and investigation commenced.
Justice Gandhi after hearing both the sides observed that impact of rape by cheating and fraud is not less than other rapes. It causes stronger psychological impact when the victim feels betrayed and cheated by the vile act of a person to whom she trusted a lot.
“Keeping in mind the aggravating and mitigating circumstances of this case, it is ordered that for the commission of offence under Section 376 of the RPC, the convict Surinder Singh shall undergo rigorous imprisonment for seven years and a fine of Rs. 5,000. For the commission of offence under Section 417 of the RPC the convict shall further undergo rigorous imprisonment for one year and a fine of Rs. 2,000. Both the sentences shall run concurrently. In default of payment of fine, the convict shall further undergo imprisonment for six months,” the judge observed.
