Maharaja had declared to accede to India after independence even in Round Table Conference
10/27/2020 12:03:38 AM
Adv. Rekha Mahajan

October 26, 1947, was the day when Jammu and Kashmir became a part of the Indian Union as on this day, Maharaja Hari Singh signed the Instrument of Accession, which was followed and signed a day later by Lord Mountbatten, the then Governor General .
Maharaja Gulab Singh bought this princely state from the British. Maharaja Gulab Singh was a skilled warrior and a seasoned politician. Maharaja Harisingh was a descendant of him. When Maharaja participated in the round table conference, then he had clearly stated that whenever India becomes an independent nation,
J&K will become a part of India. After that day a conspiracy started against him in Jammu and Kashmir, especially Kashmir, which was a Muslim-majority area. The Maharaja wanted to live with India, but the country was divided on the basis of religion, so he could not take a decision at that time.
On 24 October 1947, thousands of tribesmen attacked the state and Maharaja Hari Singh sought help from India. On 25 October Sardar Patel sent VP Menon to Srinagar and he took approval of the merger with Maharaja Hari Singh. On 26 October, Jammu and Kashmir became part of the Union of India.
After the merger of Jammu and Kashmir into the Indian Union on 26-27 October 1947, the constitutional position of the state should have been the same as in 562 princely states including the princely states of Rajasthan were merged with India. But this did not happen.
By giving it special status, the work of promoting separatism was done by the Congress governments of the Centre itself.
Jammu and Kashmir got special status due to Article 370 (Transitional Temporary Article). Even after independence, the system of obtaining 'permit' for entry into the state of Jammu and Kashmir was restored against which the then Bharatiya Jana Sangh started a country-wide movement. To give a edge to the movement, Dr. Shyama Prasad Mukherjee, the founder President of Jana Sangh attempted to enter the state without a permit, on which the then Sheikh Abdullah government of Jammu and Kashmir arrested Dr. Mukherjee and put him in jail where on 23 June he died in 1953 under suspicious circumstances. This was the first and significant sacrifice by an Indian given for the complete merger of Jammu and Kashmir into the Indian Union.
A separate constitution was made for Jammu and Kashmir. In the entire country, Jammu and Kashmir was the only state where a separate constitution was in force, according to which the tenure of the legislators of the Jammu and Kashmir Legislative Assembly was fixed for 6 years whereas the tenure of the legislators of all other states of the country had kept only for five years. A separate flag of Jammu and Kashmir was also fixed. No law passed by the Indian Parliament could be implemented in Jammu and Kashmir until the Legislative Assembly passed a resolution to implement it.
On 5 August 2019, the Union Government merged Jammu and Kashmir with India by abolishing Article 370, as a result of which the injustice being done to Valmiki Samaj, Gorkha Samaj, Western Pak refugees and women has now come to an end. Now these people can also get education, employment and take advantage of other facilities.
Kashmir problem is the problem of taking back the Pak occupied Kashmir. Today we have to talk about the United India (Akhand Bharat), the resolutions passed by the Indian Parliament in 1963 and 1994 and the territories illegally occupied by Pakistan and today we have to take back the area whom China has taken possession of, because when Maharaja Hari Singh merged Jammu and Kashmir the area of Pak occupied Kashmir was also included in Jammu and Kashmir which is today called Pakistan-occupied Jammu Kashmir.
Today, we are celebrating the merger day with great enthusiasm, lamps being lit in every house, the national flag hoisted at every square because it is not less than a festival for us. The government has also declared the merger day as a holiday.
