JAMMU, Nov 10: Sub-Judge Jammu Pawan Kumar Sharma rejected the bail application of Swar Ali who was allegedly involved in preparing forged document scam.
Report filed by Police reveals that FIR No.35 of 2017 u/s 420/465/467/468/471/120 B RPC is registered in which one Sanjay Baja) was arrested on 10.06.2017 and during investigation he disclosed that a organising gang of criminal Is luring people for arranging vehicle loans. These people make these sales letter by removing hypohecation and make fake NOC. It was also found during investigation that one Sunil Kumar in connivance with other accused have prepared fake NOC and thereafter further vehicle is old thereby causing huge loss to bank and fanance companies. It was also found that applicant Swar Ali has also purchased one Alto Car JK02BE 4363 after obtaining a loan from Citizen Co- Operative Bank and thereafter accuse Swar Ali in connivance with other accused prepared a Fake NOC and produced forged documents before RTO Jammu and managed fraudulent removal of hypothecation by way of cheating and fraud, Not only this he sold this vehicle to one Shokat Ahmed Rather by fraudulent means.
Sub-Judge Jammu Pawan Kumar Sharma after hearing APP Puja Nijohn for the UT observed that applicant cannot be shown any leniency as in my opinion the whole gang of criminal is to be brought to Justice. Although bail is a rule and jail is exception, the case in hand certainly falls in exception clause because applicant has neither participated in the allegation till date and the punishment is also on higher side. Keeping in view facts and circumstances of the case no case is made out for grant of Bail by the applicant. The offences are not only against the society but also involves the organized crime with which the innocent people fall in trap and are cheated of their hard earned Money. The finance institutions such as Banks also have Public Money which is also been denied to the Banks by illegal and fraudulent means. With these observation Court rejected the bail application. —JNF
