Court awards 7 years rigorous imprisonment to BSF jawan in rape case

JAMMU, Jan 14: Principal Sessions Judge Rajouri Jaffer Hussain Beigh awarded seven years rigorous imprisonment to Attinder Pal Singh, a BSF jawan facing trial in rape case.
According to police case, on 15.07.2016 the complainant, Satvir Kour submitted a written report before Incharge Women Cell Rajouri ordered by Special Mobile Magistrate Rajouri u/s 156 (3) CrPC against the accused Attinder Pal Singh with the averments therein that the accused is a Government servant in 125 Bn. BSF and she is the resident of Nowshera. The accused enticed her by promise of marriage and used to commit sexual intercourse with her. In the year 2015, the accused committed rape upon her due to which she conceived.
Principal Sessions Judge Rajouri Jaffer Hussain Beigh after hearing both the sides observed that accused Attinder Pal Singh was convicted for commission of offence punishable under section 376(1) RPC. Now regarding the imposition of sentence upon the accused is concerned, the nature of the offence, the circumstances of its commission, the age and the character of the offender, injury to individual or the society, effect of the punishment on the offender, are some amongst many other factors which would be ordinarily taken into consideration by the Court. The offence under section 376(1) RPC committed by the accused is punishable with imprisonment of either description for a term which shall not be less than seven years but which may be for life or for a term which may extend to ten years, and shall also be liable to fine.
The trial in this case has taken about four years and the accused is an Army official who would lose his job after his conviction in the case. For these reasons I sentence the accused, namely, Attinder Pal Singh to undergo rigorous imprisonment for seven years and to pay a fine of Rs10,000 and in default of payment of fine he shall further undergo imprisonment of like nature for 6 months.
