Court rejects bail of two employees of BDO Mahore in fraud case

JAMMU, Jan 16: Principal Sessions Judge Reasi Kamlesh Pandit today rejected the pre-arrest bail applications Jamal Din and Mohd Ashraf who are employees in BDO office Mahore in alleged fraud case.
The allegations against the accused persons/ applicants herein leveled by the complainant are that he was entitled to payment of money in lieu of the labour work he conducted in the year 2017-18 and 2019 but the accused persons/ applicants herein and other co accused when requested for payment of money by him, were delaying the same. On verification by the complainant he came to know that the accused persons have committed fraud on him and his hard earned money was diverted by them i nto account of some unknown person and have thus caused misappropriation of funds for MGNREGA works. On the complaint ,a case under FIR 93/2020 uder sections 420/409/109/506/IPC came to be registered in police station Mahore. In this case the initial police investigation prima-facie established the misappropriation of public funds due to be released to the complainant and have also hinted for unearthing MGNREGA scam allegedly committed by the accused persons/ applicants herein and other co accused persons, for which custodial investigation of the accused persons has been requested.
Principal Sessions Judge Reasi Kamlesh Pandit while rejecting the bail applications observed that in this case as already stated that the accused persons/ applicants herein are involved in fraud, misuse and misappropriation of public funds for their personal benefit and to the determinant of the claimants. The involvement of the accused persons in the crime has been prima-facie highlighted by the investigating agency. Therefore in such circumstances anticipatory bail order, if granted prematurely when investigation is still at the stage of inception or its threshold with the strong objections from the investigating agency, it can frustrate the very purpose of the investigation and real culprit may never be brought to the book. —JNF
