SRINAGAR, Jan 21: A trio of the residents of the summer capital of Jammu & Kashmir has 'misled' the Court by quoting an order passed in some other case as the one delivered by the judge in their case pending before the court of law.
Shabir Ahmad Butt son of Ghulam Ahmad Butt, Abdul Qayoom Butt son of Mohammad Sidiq Butt, residents of Natipora, Srinagar and Dr. Asif Rasool resident of Kursu Rajbagh, Srinagar committed a 'fraud' and 'cheated' the High Court by referring to the order passed by the Court with regards to WP (C) 3411/2019. Dr. Asif is a veterinarian posted in Animal Husbandry department.
Shabir, Qayoom and Dr. Asif have prayed before the court that they must be given an opportunity to be heard despite the fact that the court directed Deputy Commissioner, Srinagar to inspect the property at Court Road, Srinagar and get the 110 square feet of the building sealed along with the other stories that have already been sealed by the district administration.
The trio of residents quoted the order passed by the court in the writ petition number 3411/2019 although the property in question falls in the Court Road area under the Kothi Bagh estate. These people in alleged connivance with Sub Divisional Magistrate (SDM) Srinagar 'deceived' the judge while quoting an order not correct in the context. The writ petition in this regard is WP (C) 1791/2020.
Jan Mohammad Reshi, the aggrieved party had approached the court to seal the property belonging to him at the Court Road. He had moved a Right to Information (RTI) application seeking information about the sealing of property at the Court Road with the plea that the whole structure is sealed.
The RTI filed by Tehsildar South Srinagar read, "That as per the directions of the District Magistrate Srinagar area of 110 square feet was sealed on 12-12-2019 from each storey of a building situated at Court Road, Srinagar except from the ground floor of the same building which could not be sealed because of the law and order problem at that point of time."
The RTI reply further said that as far as sealing of 110 square feet from the ground floor is concerned we have already intimated the concerning parties to remove their belonging from the said building and in coming weeks same be sealed also, as the directions of magistrate Srinagar and process for same is going on.
This reply was given on 29-12-2020. A team of revenue officials was directed to visit the spot on January 14, 2021 and implement the orders of Deputy Commissioner Srinagar in letter and spirit. The team comprised of Nazir Ahmad, Naib Tehsildar, Kothi Bagh, Yaseen, Girdawar, Gulzar, Patwari and Ranbir Singh Judicial.
"The orders could not be implemented and in the meantime Shabir and others managed to get the relief while quoting the order issued in the property case of Natipora. They misled the court with the SDM Srinagar guiding them since he is their close relative. This is a criminal case and action needs to be taken against the trio and the SDM," said Jan Mohammad while talking to Early Times.
