JAMMU, Feb 13: During the course of jail visit at Sub Jail Reasi, applicant Mohd Ayub Ayan who is admittedly involved in FIR No. 81/2020 for offence under section 376 of IPC and is a jail inmate - presented an application to Chairman, DLSA (Pr. Distt. & Sessions Judge), Reasi seeking action against police officers/ police officials of Police Station Mahore.
The application forwarded to CJM Reasi by Chairman, DLSA Reasi for disposal under law.
In this application, applicant alleges that on 13.10.2020, Khalid Ashraf, SDPO Mahore, Rattan Singh Rana, SHO Police Station, Mahore, Ashiq Hussain, ASI Police Station Mahore, Ch. Ashiq, Havaldar Police Station Mahore, Mohd Latif, Havaldar Police Station Mahore, Onkar Singh, Constable Police Station Mahore, Mohd Latif, Constable Police Station Mahore and Vir Singh, Constable Police Station Mahore. dragged him out of his residential house and forcibly took possession thereof and implicated him in a false FIR, in which applicant - as per communication of Worthy Chairman, DLSA (Pr. Distt. & Sessions Judge), Reasi is allegedly involved in as serious an offence as one under 376 of IPC. Applicant also alleges that ornaments were taken away and his house was also ransacked by non-applicants. He also asserts that an application moved in this regard before Judicial Magistrate 1st Class, Mahore was declined to be entertained. In the same breath, it is also alleged that matter was also brought to the notice of Superintendent, Sub Jail Reasi, District Magistrate Reasi, SSP Reasi, DIG of Police Udhampur as also to the notice of IGP Jammu and DGP of J&K but till date no tangible action has been taken. And finally, applicant seeks registration of first information report (FIR) under relevant provisions of law against non-applicants.
CJM Reasi Amarjit Singh Langeh after gone through the application observed that the whole trajectory of allegations in the application, indeed, seeks to dis-credit manifestly all the functionaries mentioned in the application as outlined hereinabove. Tangibly, applicant has tried to give a veneer of his implication in the case FIR No. 81/2020 for offence under section 376 of IPC to the anarchy allegedly displayed by non-applicants by joining ranks in cahoot with each other.
CJM Reasi Amarjit Singh Langeh further observed that if an act of anarchy as alleged by applicant in this application is brought to the notice of Sr. Superintendent of Police - Reasi, naturally it would have drawn her response consistent with law. Resultantly therefore, it would be in the fitness of things to gain traction as to how the application of applicant has been responded to by SSP, Reasi. Accordingly, let a status report in the matter at hand be called from SSP, Reasi so that matter thereafter be dealt with in accordance with law. SSP, Reasi therefore is directed to submit status report by or before next date of hearing without failure. —JNF
