JAMMU, Mar 21: Anti-Corruption Bureau (ACB) produced chargesheet against accused persons namely Mohd Farooq the then Patwari Halqa Dudu-Basantgarh (now Girdawar) S/O Late Mohd Sadiq R/O Kadwah, Tehsil Basantgarh, District Udhampur and Mohd Javed S/O Late Mohd Amin R/O Dudu, District Udhampur (beneficiary) before the Court of Addl. District & Session Judge, Anti-Corruption Udhampur in case FIR No. 03/2016 under section 5(1) (d) r/w section 5(2) of J&K P.C Act and section 467,468,471 & 120-B/RPC registered against them in P/S VOJ (Now ACB)
The instant case was registered on the basis of an enquiry conducted by the Sub-Divisional Magistrate Basantgarh into the allegations for tampering with the revenue record pertaining to Khasra No.76 (land measuring 2 kanals 18 marlas) in village Dudu which revealed that Mohd Farooq the then Patwari Halqa Dudu-Basantgarh, by abusing his official position hatched a criminal conspiracy with Mohd Javed (beneficiary) and made false/fictitious entry of Girdawari to favour the beneficiary.
During verification, it reveals that Mohd Javed with the intention to grab the land of his sister namely Asmat Begum, entered into a criminal conspiracy with Mohd Farooq the then Patwari Halqa Dudu-Basantgarh and got made illegal entries of Girdwari in the revenue record by tampering, to register his claim on the land. The then Patwari Halqa Dudu Basantgarh Mohd Farooq despite of having knowledge that the land belongs to Mst. Asmat Begum and is under her cultivation, by abusing his official position, made the wrong Girdwari entry into the Girdwari Register during the Girdwari (Rabbi) 2005 for 04 Kanals 08 Marlas at khasra No.76 (min) mentioning that it was a self cultivated piece of land (Khud Kasht) through Mohd Javed beneficiary by manipulating the records, thus conferred the wrongful gain to the beneficiary thereby deprived the actual owner of her rightful claim.
The case was chargesheeted in the court of law after obtaining Govt. sanction from the competent authority. The next date of hearing has been fixed for April 23, 2021.
