Court rejects bail of snatchers

JAMMU, Nov 29: CJM Jammu, Amarjeet Singh Langeh has rejected the bail applications of snatchers Balwinder Kour W/O Kulwant Singh and Pavaneet Singh S/O Narinder Singh. The police case said that a written report with police post Gadigarh alleging therein that while she was coming home after attending function at Jammu and when she reached Gadigarh one Scooty without registration number with a lady pillion rider reached from opposite side and stopped near the vehicle.
The complainant alleged that pillion rider lady snatched her purse containing one Mangalsutra, two golden lady rings and cash amounting to Rs. 20,000, ATM cards and some other documents. Based on this complaint, FIR 263/2021 for offence under section 382 of IPC was registered with police station concerned and investigation started.
The CJM Jammu while considering bail application of persons who seem to be prima facie habitual offenders, discretion to grant bail cannot be exercised in a whimsical manner and interest of society at large in such cases has also to be duly considered and taken note of (Vide (2007) 1 SCC 70).
In the case in hand, all factors like nature and gravity of offence involved, character of evidence in support of allegations, punishment that the offence involved carries-which is up to 10 years of imprisonment and general impact on public at large of the offence involved in the case-go poignantly against petitioners more particularly when investigation is at initial stage and subject matter of theft has not been wholly recovered. With these observations Court rejected bail application.
