Four gets life-imprisonment in murder case

JAMMU, Aug 2: 2nd Additional Sessions Judge Jammu Rajinder Sapru awarded life-imprisonment to four accused namely Rakesh Khajuria, Gourav Sharma, Parveen Singh @ Lucky & Barkat Singh who were facing trial in murder case for the last 14 years.
The case as narrated in the police report submitted in terms of Section 173(2) Cr PC are that on 26-3-2008 a written complaint was lodged by one Gurdeep Singh in the charge-sheet with the police station concerned, stating that while he and his brother namely Harminder Singh @ Pindi, who was doing business of Cable Network distribution for J-K City Cable Channel in the villages of Keerpind, Khour and Phinder areas, were returning home via Phinder, in their Zen Car and had reached near Canal Head at village Phinder, two other cars had started following their car.
One of the said cars after overtaking their car had stopped in-front of their Car and thereby had intercepted their car from proceeding further. The other car in the meanwhile had also stopped towards the rear side of their car. The car which had stopped their car and the other car which had stopped towards the rear side of their vehicle were belonging to accused Barkat and Lucky respectively. The accused after alighting from the said two cars had started smashing the glass panes of their car with the tokas in their hands.
Barkat fired two shots from his pistol in the air as a result, he and his brother had come out of their vehicle and had started running towards the wheat fields in different directions but all the accused persons had chased his brother into the fields and when his brother had ran about 150 meters accused persons caught hold of his brother and attacked him with the tokas in their hands to avenge their old enmity, as a result of which his brother has sustained grievous injuries on his person.
In the meanwhile Bhupinder Singh along with his mother also reached the spot on a scooter as his mother was returning home from the house of her Sister-in Law. On their raising hue and cry on the spot the accused persons had left the deceased in a pool of blood at the spot. Thereafter, a Gypsy was seen coming which was stopped and requested to shift the injured to the hospital. Meanwhile some police personnel had also reached there and had shifted his injured brother to hospital from the spot. He himself has come to the Police Station for registration of Case against the accused person.
2nd Additional Sessions Judge Jammu observed that the prosecution has succeeded in proving beyond a reasonable shadow of doubt that accused in order to avenge the old enmity had reached the place of occurrence i.e Canal Head Tanda and there in furtherance of their common criminal intention, had chased deceased Harminder into a wheat field and there they had inflicted several chop injuries on his person with the Tokas carried by them, which ultimately had resulted into his death. The judge held the accused persons guilty for commission of offence U/S 201 RPC. Accordingly, the accused are also convicted of offences U/S 201 RPC.
