Court convicts duo for murder, awards life imprisonment

Udhampur, Oct 14: Principal Sessions Judge udhampur Virender Singh Bhou, on Tuesday convicted duo Kaka Ram son of Nek Ram resident of Sadota Tehsil Pancheri, District Udhampur and Khem Raj Son of Isher Dass resident of Basnote, Tehsil Moungri, District Udhampur, are sentenced to undergo rigorous imprisonment for life for murdering one Siraj Din and his son Beniya in 2015 .
As the prosecution story on 23.06.2015 complainant Abdul Karim Son of Jamal Din Gujjar resident of Kheri, Tehsil Bishnah, Jammu, lodged a written report in the Police Station stating therein that his real brother Siraj Din who had purchased one piece of land about 30 years ago at Sadhota Mohra Marri, Tehsil Panchari from Kaka Ram and had constructed house there and was residing in the said house for the last thirty years. On 22.06.2015 he came to Gehlot in connection with death of one of his relative and on 23.06.2015 in the morning Abdul Rashid Son of Birbaz Gujjar resiodent of Madhota called him on telephone that Siraj Din had been killed by some person(s). On this he reached at the house of his brother and saw that both Siraj Din and his son Baniya had been killed by some person.
On this panchari police registered a case under FIR No. 34/2015 Under sections 302,449,34 RPC , pertained to killing over a land dispute and started investigation and presented challan in the court of law .
Principal Sessions Judge Virender Singh Bhou, while pronouncing the verdict, held that the prosecution had successfully established the guilt of the accused under Section 302 RPC. The convicts, namely, Kaka Ram S/o Nek Ram R/o Sadota Tehsil Pancheri, District Udhampur and Khem Raj S/o Isher Dass R/o Basnote, Tehsil Moungri, District Udhampur, therefore, are sentenced to undergo rigorous imprisonment for life for the commission of offence under section 302 RPC and pay a fine of Rs. 10,000/- each. In case of default of payment of fine the convicts shall undergo further simple imprisonment of six months. Convicts are further sentenced to undergo rigorous imprisonment for ten years for the commission of offence under section 449 RPC and pay a fine of Rs. 5,000/- each. In case of default of payment of fine the convicts shall undergo further simple imprisonment of three months. The period of detention already undergone during investigation and trial shall be set off in terms of Section 397-A Cr.P.C against the substantive sentence of imprisonment. All the sentences shall run concurrently.
Fine, if realized shall be paid to the legal heirs of the deceased persons. State Legal Services Authority J&K is recommended and requested to pay the statutory compensation to the legal heirs of the deceased persons in terms of victim compensation scheme.
