SC stays contempt proceedings against VC LAWDA | | | EARLY TIMES REPORT Jammu, July 28: A Bench of Supreme Court of India comprising Justice Aftab Alam and Justice R. M. Lodha had stayed the contempt proceedings against VC LAWDA arising out of the judgment of the Division Bench of J&K High Court. This order has been issued in a SLP filed by the Lakes and Waterways Development Authority (LAWDA) against the judgment of Division Bench of J&K High Court at Srinagar. Earlier, a Division Bench of J&K High Court in an appeal filed by Mohd Abbass Wanth, directed LAWDA to pay the petitioner amount of Rs more than 6 lacs along with interest @ 8% from January 1, 1999 as compensation for damages caused to the house of petitioner because of dredging operations. On the other hand, LAWDA submitted that house of Mohd Abbass Wanth suffered no damage at all. On April 19, 2010, the J&K High Court had issued contempt notice to Mr. Irfan Yasin, Vice Chairman of LAWDA for failure to comply with the judgments of the Division Bench and had directed the amount to be deposited with the Registry of the J&K High Court within 4 weeks. The Bench of Supreme Court comprising Justice Aftab Alam and Justice R. M. Lodha after hearing Senior Additional Advocate General Mr. Gourav Pachnanda appearing for the J&K State with Adv Sunil Fernandes, Advocate-on-Record, the Bench issued notices to the Respondents and directed that contempt proceedings against VC LAWDA arising out of impugned judgment shall remain stayed till further orders.
