HC modifies order of HRA/CCA to migrants employees | | | Early Times Report Jammu, Aug 4: Justice Mansoor Ahmed Mir of Jammu & Kashmir High Court Jammu Wing today in an application filed by the migrant employees ordered that official respondents are at liberty to release HRA/CCA in favour of 10 more migrant employees provided they are entitled in terms of the impugned order. Advocate Veenu Gupta appearing for the respondents has moved application seeking impleadment of 10 applicants as respondents. Advocate MK Raina counsel for the petitioners stated that he has no objection in case the application is allowed. Accordingly the applications are arrayed as respondent and shall figure as respondent 21 to 30. Justice MA Mir after hearing both the sides observed that the counsel for the respondents seeking clarification/ modification of the order dated July 27, 2010. It is contended that petitioners have questioned the order on the ground that respondents have stayed the payment of HRA and CCA to the petitioners. Notice came to be issued to respondents and in the meantime operation of impugned order came to be stayed which has adversely affected the respondent 21 to 30. The grievances of these respondents under the grab of the stay order respondents have not released the HRA and CCA to them. Upon this Court ordered that order dated July 27, 2010 shall not come in the way of respondents 21 to 30, the official respondents are at liberty to release the HRA and CCA in their favour provided they are entitled in terms of the impugned order.
