AUTONOMY FOR J&K STATE

Recently the Prime Minister of India was heard speaking that he is in favour of considering autonomy , as demanded by National Conference, for the state of J&K which was earlier rejected by the then Prime Minister of India Sh. A.B.Vajpayee. One fails to understand what sort of autonomy is the Prime Minister of India going to grant to J&K State when it already enjoys a Special Status unlike other states of India. The meaning of autonomy and its provisions need to be made clear to the people of J&K State. Every citizen has a right to know about what autonomy refers to ? Does it mean going back to the position of 1953 ? Now if we presume that autonomy means going back to 1953 position and erosion of all central laws, in vogue at present in the state, then it gives rise to the following questions and every citizen would like to seek, answers to them.


Will the Supreme Court of India lose its jurisdiction or influence over state High court? Will any decision of the State high court not favouring any individual or community in the State cease to be challenged in the Supreme Court of India?
Will Election Commission of India lose its jurisdiction over election machinery of state?
Will Indian Parliament have no powers to amend or make or review any law for the state?
Will the comptroller and Auditor General of India lose its authority to exercise check on the utilization of finance provided by the Central government after the State is declared autonomous ?
Will the subjects listed in the concurrent list of Indian Constitution be rendered ineffective and irrelevant in the State?
Will the government of India fall back upon central subjects like Defence, currency and foreign Affairs, as was the practice earlier followed, for maintaining hold on J&K State? Or will it also surrender the last two subjects to the will of State and retain defence only?
Will the executive head of the state be called the Prime of J&K State instead of Chief Minister? Similarly will the term ‘governor’ be replaced by the term “SADRI-RIYASAT” as was the practice followed earlier in the State?
Will education exclusively remain under the jurisdiction of the State? If yes, shall the role of U.G.C , C.B.S.E , Medical , Technical and Dental Councils of India cease in developing the quality of education in the State?
Will the government of J&K be allowed to introduce the practice of Visa or seeking permission for entering into J&K State as was the practice earlier followed when Late Sh. S.P.Mukerjee was detained on his entry into the State for violating the rules?
Will the government of India allow the north-eastern states including Nagaland to Seek autonomy from Indian Union on J&K pattern ?
If the religion becomes the basis for considering autonomy to the State of J&K , is it justifiable to stop the Muslims of India, the Sikhs, the Buddhists and the Christians from making a similar demand?
Granting autonomy and moving back to 1953 would still allow India to keep the Indian army on the soil of State and thus continue to have occupation of land to the resentment of separatists and in turn the Central government will be obliged to pay price for it in the form of providing liberal finance , food supplies and fulfill necessities of the citizens of J&K State. Will Indian government fulfill such obligations faithfully?
Granting autonomy will see India down in the eyes of neighbouring countries. Its might as super power shall be underestimated by Burma, Nepal, Bangladesh, Srilanka and Pakistan. It will encourage China to move forward from the present areas of Gilgit and Baltistan under her influence in Pakistan to the Arabian Sea thus encircling India. How will India face such a situation?
The refugees of 1947 from P.O.K and Pakistan living as refugees in Jammu are till date not treated as State Subjects of J&K State. How will government of India address the problems of the said refugees and at whose mercy will they be left in a state after it is declared antonomous?
Persuming that autonomy refers to restoration of Pre- 1953 position, will it mean granting autonomy to the state- within the Occupation of Indian Army or autonomy within the Indian Constitution?
People feeling suffocated under the umbrella of autonomy may migrate to other parts of the country from J&K State. Will Central Government stop it or allow it?
Granting autonomy may temporarily provide relief to the government of India.It may suit local leaders of Kashmir belonging to regional & national parties, moderate and hardcore separatists as well. Giving a sense of victory to National Conference, it may suit PDP for the concept of autonomy being closer to Self rule idea? However , granting autonomy is no gurantee for peace to prevail in J&K State as the separatists provoked and financed by Pakistan will not allow peace to prevail till they push the state back to 1947 from 1953 ignoring the reality that Maharaja Hari Singh Ji the ruler of the State acceded to India in 1947 which was later recognized by successive state legislatures and governments.


Lastly if the ruling party at the centre is left with no alternative except to grant autonomy, it should then first listen to the voices of Jammu, Ladakh and displaced Kashmiri Pandits from valley. The Dogras of Jammu who form a strong patriotic force strongly oppose the concept of autonomy . It is being opposed by non- Kashmrir speaking Muslims of Jammu, the Ladakhis , the Sikhs and the refugees from POK and Pakistan of 1947 . It is strongly opposed by the Kashmirir Pandits who are living as displaced persons in different parts of country being the worst sufferers and the first victims of militancy whom central and state governments failed to provide security to save their life, property and honour in the valley


Let government of India pass a legislation and carve out separate States- the state of Ladakh and the State of Jammu as the people of these two large provinces strongly oppose autonomy proposal. Let government of India fulfill the long pending demand of home land of Kashmiri Pandits, the original inhabitants of Kashmir Valle presently living like refugees. Let this homeland, within the valley, form a separate state administered centrally under union territory status.
