Jammu, May 5: From defiant to open revolt mode, the suspended MLAs of the BJP today declared unhesitantly they were the ‘real BJP' and Prof Chaman Lal Gupta continues to be the leader of the Legislative party. Presenting copies of reply to show cause notices, two MLAs pleaded innocence and lay the whole blame of cross voting on chief whip Ashok Khajuria.In yet another twist to the developments, one more MLA among the suspended members BB Bodhi got interim relief from the court which has ordered temporary stay to the proceedings of the Disciplinary Action Commitee of the BJP led by OP Kohli.
The two MLAs Baldev Raj Sharma and Lal Chand quoting constitutional provisions of the state said on account of the fact they (suspended members) were in majority, they formed what they said real face of the party in the House, ruling out in the same breath they do not intend to nor is there move to form separate group or the party. Asserting that Prof Gupta continues to be their leader, the duo maintained they were neither worried about their expulsion from the party nor on account of any such action in the House but were certainly 'pained' to see how this veteran leader and his family were being victimised by the some elements in the party. The suspended Members maintained anti defection law was not applicable in their case as they were in majority group.
" The imbroglio of 7 and 4 was only expected as this is a fallout of the resistance we showed over two years back when high command wanted to impose its decision of having a leader in the House other than Prof Gupta......this is apparently a sequel of the conspiracy against him to sideline him in the party affairs ", Baldev Raj said while speaking to media today. "We resisted that decision then simply because name had to be chosen with consensus and today also we maintain same stand", he said alleging that these were the tactics from within to weaken the party .
While asserting they had voted in favour of the BJP candidate once again contested the parametres adopted by the high command in holding them guilty, contending in secret ballot system for the polls how it has been established as to who voted in favour of whom. Targetting Ashok Khajuria , Sharma said that he showed his ballot paper to the son of the party candidate, an action which automatically should have rendered the vote invalid. "No body knows to which party actually Khajuria has cast his vote .......", Baldev Raj Sharma said.Moreover Khajuria not only avoided the suggestion of abstaining from voting contemptuously but was also seen in the company of a bureaucrat known to be close to the ruling alliance, Sharma contended in his reply.
" I wonder how high command has overlooked all these facts.....on what grounds and merits they have given clean chit to the four ......how I am in dock and Ashok Khajuria is being treated as holy cow.....", Baldev Sharma questioned alleging that those who have indulged in cross voting are treated as very loyal to the party . Sharma further alleged it was not a cash for vote controversy but a cross voting conspiracy to damage the party indulged in by those hobnobbing with ruling alliance. They also said it was intriguing that party has not taken notice of their opne offer of undegoing narco or any other test along with four MLAs who have been given clean chit so that truth comes out but as of date they have not come forth .
The two MLAs said nothing else was important for them at this stage than cleansing the blot of cross voting act in front of their supporters which is why they seek a fair action from the party high commad by way of revoking suspension order against the,. Lal Chand pleading innocence maintained he is a patient of malignancy and this action had caused him more pain.
Meanwhile, a court order on the application filed by BB Bodhi today said the issuance of show cause notice against the applicant be declared null and void being illegal and without jurisdiction and for the permamanent prohibitory injunction restratining temporarily the non applicant (party) from proceeding against the applicant till May 23 when non applicant has been asked to file objections, if any.
