| Accused facing trial under NDPS Act acquitted as prosecution witnesses turn hostile | | | Early Times Report
Jammu, Nov 29(JNF): Principal Sessions Judge Kathua MK Hanjura has acquitted one Feroz Ahmed s/o Mohd Ibrahim r/o Natipura Chadoora District Budgam who was facing trial in NDPS Act for the last more than 6 years, as the prosecution witnesses takes U-Turn. While acquitting the accused Principal Sessions Judge Kathua MK Hanjura after hearing Public Prosecutor Ravi Gupta for the state whereas Adv Neelam Sharma appearing for the accused, took serious note of the statements of witnesses namely Kuldeep Kumar then Sub-inspector and Joginder Kumar Guard and Abdul Rouf examined by the prosecution in the instant case, the proceedings of the case warranted to be truncated. None of the witnesses have support the prosecution version. They have simply smashed case in its entirety. They have shaken the very substratum of the prosecution case. They have demolished the prosecution edifice. There is no incriminating evidence against the accused on record. The prosecution case straight way merit the acquittal of the accused and acquitted the accused from the charges leveled against him. Principal Sessions Judge Kathua MK Hanjura further observed that one can understand an ordinary private individual turning hostile, in case for any reason including pecuniary considerations, fear, favour or interest. But a whole official of Govt Dept contingent of personal making a U-Turn is simply not acceptable. The behaviour and performance of these witnesses namely Kuldeep Kumar then Sub-inspector and Joginder Kumar Guard who reported the seizure of drugs to their senior officers, subsequently changed colour in the court like a chameleon. According to the case that the accused has arraigned on a charge of possessing 70 boxes of Spasmoprosvan, 4 Box of Revice (injection), 21 boxes of Protvin (injection, tool set-I piece and Amino Mass Food. These drugs are alleged to have been recovered from the accused in wee hours on the morning of the July, 2, 2007 while routine checking of buses at Lakahnpur. Police registered a case u/s 8/20/21 NDPS Act and after completion of the investigation challan was presented in the Court. |
