| HC imposes costs of Rs 50,000 on two Gun Factories | | | Early Times Report Jammu, Jan 8: Justice Hasnain Massodi of State High Court Jammu Wing has dismissed the petitions filed by Surat Singh on behalf of Jagat Gun Works along with CMPs filed by Vinay Kumar are dismissed with costs of Rs 50,000 each to be deposited in the account of J&K State Legal Service Authority and allowed the two petitions filed by Gun Manufacturers Association. The controversy in the petitions related to genuineness/ authenticity of Gun manufacturing license claimed by Surat Singh to have been granted by the competent authority in favour of M/S Jagat Gun Works Gangyal Jammu authorizing it to manufacture 1840 B.L/M.L Guns Per Annum with validity up to December 31, 2012. License No 1/X/2004 dated November 4, 2004 claimed by Vijay Kumar to have been granted by the competent authority in favour of Himalaya Arms Company valid up to December 31, 2012. The Gun manufacturers Association Jammu has filed two petitions to protect the right of the genuine gun manufacturers and to restrain M/S Jagat Gun Works and Himalaya Arms Company from carrying on gun manufacturing business. Justice Hasnain Massodi after hearing both the sides issued notice to Ministry of Home Affairs regarding the licenses in question in compliance of the order October 30, 2012, Molay Sanyal Under Secretary Ministry of Home Affairs New Delhi appears with the requisite record. In the reply, respondents submitted that the Gun Licenses were forged and record including the communication from District Magistrate's Jammu Office to Ministry of Home Affairs, fabricated by the petitioners. It is alleged that FIR NOs 3/2010, 117/2011 & 139/2011 u/s 420/467/468/471 RPC registered with P/S Gangyal Jammu. FIR NO 7/2010 P/S Peermitha Jammu stands registered against Vinay Verma. The respondents insist that the petitioners have not approached with clean hands and have withheld necessary information from the court. The official record produced by Under Secretary believes the petitioners' case set out and lends support to the Gun Manufacturing Association Case, the petitioner Surat Singh & Vinay Kumar appears to have fabricated the record and forged the Gun Licenses that they claim to have been issued by Ministry of Home Affairs in their favour. The petitioners as pointed by Under Secretary Home Affairs referred to official record by him have fabricated the record and thereby brazenly filed petitions to invoke the jurisdiction that is essentially equitable in nature and Court observed that petitions filed by Surat Singh and Vinay Kumar dismissed with cost of Rs 50,000 each. —JNF |
