HC directs concerned authority to consider petitioners case

Jammu, Feb 19
First Puisne Judge of J&K High Court Justice NA Kakru, in a writ petition filed by two institutions seeking affiliation for running Elementary Teacher Training (ETT) course, after hearing Advocate Vishal Sharma appearing for the petitioners and Advocate DS Chouhan appearing for JKBOSE, issued notice to Commissioner/ Secretary Education Department, Secretary J&K Board of School Education with the direction to consider the petitioners also on the touch stone of the norms and relevant policy rules. According to the petitioners, institutes for providing Elementary Teacher Training Course have applied for issuance of No Objection Certificate to run two years ETT Diploma course. A committee constituted for the purpose, after proper inspection of the petitioners institutes situated at Kathua, recommended issuance of no objection certificate in favour of the institutions. Similarly, the respondent Commissioner/ Secretary Education Department issued NOC to run two years Elementary Teacher Training Course in favour of these institutions for the academic session 2005-2007. However, the petitioners had also applied for grant of affiliation after completing all the formalities as required though no specific conditions or norms has been fixed by the J&K Board of School Education in this behalf. The said respondent slept over the matter for more than a year and on October 16, 2006 a notification was published in the newspaper granting provisional affiliation to 120 institutions for running two years Elementary Teacher Training Course for the sessions 2006-2008 but the petitioners were neither granted nor refused the affiliation in spite of the fact that respondent Board had already received affiliation fee of Rs 7000/- from the petitioners. The petitioners prayed before the court for issuance of direction to the respondents to grant affiliation to their institutions to run the course for 2006-2008 sessions
