If it was the Chairman J&K state Accountability Commission, Justice R P Sethi who had put in his papers, three months ago, protesting against government's undue interference in the functioning of the autonomous commission, now it is the Chairman of the State Human Rights Commission, Justice Mir who has resigned his post alleging government's non seriousness in implementing the recommendations of the commission, aimed at checking the violations of human rights. Since the resignation of Justice Sethi from the chairmanship of Accountability Commission, the functioning of the commission has been paralyzed, with the government unable to find his replacement even during last three months. The commission which was functioning very actively, with many stalwarts in the administration and public life brought under scanner for their alleged misdeeds and adopting underhand means, has not booked even a single case of corruption against any officer or politician. In fact the commission has been absolutely non functional for last three months, with the corrupt rejoicing over the development. The politicians with corrupt mindset had indeed heaved a sigh of relief over the virtual death of the Accountability Commission. No eyebrow was raised by the politicians, nor any issue has been raised in the legislature over the virtual unceremonial death of the Accountability Commission. But in the case of the resignation of Justice Mir from the chairmanship of SHRC, the state assembly which is in session currently witnessed an acrimony, with opposition NC members charging the government of its complicity in the violation of human rights and not allowing the commission to function effectively but instead adopting an attitude of non-cooperation and placing hurdles in the way of the commission. It is not withstanding the fact that the government has only recently constituted a cabinet sub committee, headed by Deputy Chief Minister, Muzaffar Hussain Baig, who is also the Law Minister, to monitor the implementation of the recommendations of the HRC. The resignation of the chairman coming as it does on the heels of the appointment of cabinet sub committee to monitor the implementation of the recommendation of the commission is an ample proof that justice Mir has acted in haste and it is in this light that the refutation of allegations leveled against the government by him, by the Deputy Chief Minister and Law Minister Muzaffar Hussain Baig have to be read. As Mr. Baig has pointed out some of the recommendations of the commission could not possibly be implemented and that the commission only over stepped its jurisdiction and terms of reference by meddling in the affairs, which were never in its domain, seem quite convincing. As pointed out by Mr. Baig the HRC which was over sensitive about the appropriate actions taken by the security forces against the perpetrators of violence and massacres, it never showed any concern for the violation of human rights by the terrorists who indulged with impunity in wanton killings of the innocent, including women and children. Nevertheless the resignations of the chairman of two important commissions in the state have come as a blow to the prestige and credibility of the government. The government will be well advised to expeditiously find replacements of the Chairman of the two prestigious commissions.
