| Selling fuel from BSF, CRPF vehicles | | Court orders further investigation of the case | | Jammu, Feb 21 Chief Judicial Magistrate Jammu Mr. Sanjay Dhar today directed SSP Jammu for further investigation of the case regarding selling of fuel from vehicles belonging to BSF and CRPF. According to the police case on July 8 last police received information from reliable sources that accused Tejinder alias Bittu is procuring fuel from vehicles belonging to BSF and CRPF and selling it to public. On the basis of this information, police swung into action and raided the premises belonging to Tejinder Singh at Transport Nagar Jammu and found that Constable Satpal of BSF driver and Head Constable Gajinder Singh of CRPF driver along with driver Ranbir Singh Head-Constable of CRPF, were taking out diesel from their official vehicles to sell the same to accused Tejinder Singh, Ved Parkash, Mohan Singh and Romesh Singh. Thus accused Gajinder Singh Head Constable CRPF, Ranbir Singh Head Constable and Sat Pal Constable BSF are alleged to have committed offence u/s 409 RPC whereas the other accused are alleged to have committed offence u/s 411 RPC. While directing further investigation of the case, CJM Jammu Mr. Sanjay Dhar observed that the investigating officer has conducted the investigation of this case in an unprofessional manner and has not investigated the aspect relating to entrustment of diesel to the officials of the BSF and CRPF. In this case, neither any record of BSF and CRPF showing the entrustment of diesel to the accused Gajinder Singh, Ranbir Singh of CRPF and Sat Pal of BSF, has been seized nor any official/officer of BSF or CRPF, responsible for allotment of diesel to vehicles of BSF, CRPF, has been examined as witnesses in this case. The investigating officer has only investigating the aspect of seizure and its sale by the three officials of CRPF/BSF to the other accused. So the most important aspect relating to entrustment to accused Gajinder Singh, Ranbir Singh and Sat Pal has remained untouched during the investigation of the case. By referring various judgments and the law laid down by the Supreme Court, the CJM further observed that it is clear that this Court does have powers to direct the police to make further investigation of the case in the face of the fact that investigation in this case is unsatisfactory and incomplete. There is scope for further investigation of the case and directed SSP Jammu to get this case investigated on the aspects in the light of the observations made.
