| Deep Desi Ghee brand found spurious; fine imposed on manufacturer, distributors | | | Asif Iqbal Naik Kishtwar, Feb 18: In a land mark judgment the Additional District Magistrate Kishtwar Rajesh Kumar Shavan (KAS) who is adjudicating officer under the food safety and standards Act 2006 has imposed Rupes 3.00 lakhs penalty on a spurious Ghee company and its allies. As per the prosecution "Deep Classic cooking medium" commonly projected as Desi Ghee has been found misbranded and unfit for human consumption. The samples of Ghee lifted by Food Safety Officer were sent to public food analyst Jammu and found spurious. Challan was produced before the court of Addl. District Magistrate (ADC Kishtwar) R.K. Shavan who after hearing the case imposed the penalty of 3 Lakhs. During, as per the report of public food analyst Jammu, ADM Kishtwar found guilty the manufacturer / distributor and the food business operators. The manufacturer "Tapan Agro industries (Pvt. Ltd) Dayal Bagh Agra (U.P)" has been penalized with a fine of Rs. 1.40 lakh and the main distributors Bodh Raj Vishno Das Gupta 7C Nehru market Jammu who distributed the food article to Kishtwar have been penalized 1.00 Lakh, while the food business operators Jughal Kishore Son of Chuni Lal Gupta (Janta Atta Store Shaheedi road Kishtwar )and Narinder Kumar Son of Paras Ram (Paras Ram Narinder Kumar Shaheedi road Kishtwar) both Resident of Kishtwar were penalized with rupees thirty thousand each. It has also been established during the arguments that this brand of Deep Ghee was previously found adulterated two years ago but the case is still pending in the court and the manufacturer is supplying misbranded item without any deterrence or accountability. The adjudicating officer has not only imposed a fine rupees 3 Lakhs, but also directed the manufacturer "Tapan Agro industries Ltd. Agra (UP)" to recall/ withdraw the food article from the market immediately after issuing notice in the national daily under intimation to the court. The court of adjudicating officer while delivering the judgment has held that in order to free the society from the menace of adulteration such cases need to be dealt with iron hands. Soon after the decision, the two offender's food business operator's deposited sixty thousand fine in the court. Sajjad Hussain Gagroo Food Safety Officer Kishtwar and Tariq Ahmed designated officer appeared from prosecution side. |
