| HC stays selection of Excise Guards | | | Jammu, Feb 27 Justice Hakim Imtiyaz Hussain of J &K High Court Jammu wing, in a writ petition filed by highly qualified candidates challenging the selection of 227 candidates against class IV posts in Excise and Commercial Taxes Department, has stayed the selection of 50 selected candidates and rest of the candidates shall remain subject to final outcome of writ petition. This significant order was passed in a writ petition filed by Mohinder Kumar claiming to be a BSc, B.Ed, M.Ed and Joyti Parkash having degree of B.Sc and Diploma in computers software, who applied for the post of class IV in Department but did not figure in the final selection list while many of the candidates who had not figured in the short listing were enlisted in the final selection list. After hearing Advocate HC Jalmeria appearing for the petitioners and Additional Advocate General BS Salathia appearing for the government, Justice Hussain admitted the petition to hearing and issued fresh notice to Commissioner/Secretary Excise Department and Deputy Commissioner Commercial Taxes for filling counter affidavits. . The notices which were accepted by AAG on behalf of respondents sought two weeks time for filling counter affidavit which was granted. Court also issued notice to Chairman State Level Selection Committee Excise and Taxation and respondents number 227 ordered to be served through publication and in the meantime selection of 50 guards shall remain stayed and selection of rest of the responders shall remain subject to final outcome of the writ petition. Court clarified that this order is however, subject to objections from other side. |
