HC stays further proceedings in the selection process of constables

Jammu, Feb 27
Justice Hakim Imtiyaz Hussain of J &K High Court Jammu wing in a much publicized selection for the post of constables in IRP 13 and 14 Battalions, in which state constituted fresh selection board, has directed that no further proceedings be initiated in the selection process.
Justice after hearing Sr. Advocate UK Jalali with Adv Anil Khajuria appearing for the 35 petitioners and Additional Advocate BS Salathia appearing for the state respondents issued notice to the respondents and granted two weeks time to the state to file the objections, in the meanwhile no further proceedings be initiated in the selection process.
This court direction has been passed in writ petition challenging the Government order of January 10, 2007 by virtue of which the physical endurance test for the selection of the candidates for recruitment in IRP from Jammu and Kathua Districts has been declared as null and void and fresh recruitment Board constituted for carrying out fresh selections. It is further submitted in the petition that petitioners applied vide advertisement notice August 26, 2006 for the post of constable in IRP 13 and 14 Battalion and after qualifying the physical measurement and outdoor test, the petitioners were directed to appear in the written examination. The petitioners were waiting for the result of written examination but it surfaced in the local newspaper that the selection process carried out, in which petitioners had appeared, has been declared null and void and another board has been constituted.
The petitioners prayed before the court for quashing the orders impugned in the present writ petition by virtue of which whole selection process carried out by the erstwhile board has been cancelled, being arbitrary, illegal and glaring example of non-application of mind besides the same being against the principles of natural justice and also seeking directions to the respondents to complete the process of selection carried out by the erstwhile board by publishing select list.
