| SIT seeks stay on film made on the life of Anara | | | Jammu, Feb 27 In a much publicized case under FIR No 24/2005 registered with P/S Women Cell, Canal Road Jammu the Special Investigation Team appointed by the DGP on the directions of CJM Jammu on January 21,2006, has filed an application for a direction to Sharmila Tagore Chairperson Central Board of Film Censorship, Mr. KK Yadav , Director Film City Mumbai, Ashok Pandit, Producer Film City Mumbai and Anara Gupta not to release Film ‘Anara” for public viewing during investigation/ trial in the said FIR. It is alleged in the application that the investigating agency is vigorously investigating the case FIR No 25/2004 with the guidelines and directions issued by this Court. However, the investigating agency has come to know that a film has been made on the life of prime suspect Anara Gupta by KK Yadav and Ashok Pandit, wherein Anara Gupta is enacting her own role. It is alleged that Chairperson Central Board of Film Censorship Mrs. Sharmila Tagore is likely to release the said film for public viewing. If the said film is released; it will hamper the investigation, SIT said in its application Chief Judicial Magistrate Jammu Mr. Sanjay Dhar after hearing Advocate MA Bhat appearing for the SIT and perusing the application, observed that merely because one of the suspect in the case is making film on her own life with the assistance of respondent KK Yadav and Ashok Pandit, does not mean that whatever story about the life of Anara Gupta has been portrayed in the said film is the gospel truth. The investigating agency is not bound to accept the correctness of the version about the life of Anara Gupta given in the said film. Public sentiments are guiding factor for investigating agency or the Court. The Investigating Agency has to go by the facts and material collected during investigation of the case. Even if, image of Anara Gupta portrayed as that of an innocent person and an angel in the said film, such image of Anara Gupta is not going to effect proceedings before investigating agency and the Court, because it only a fiction and not truth. If during investigation of the case, the investigating agency finds material showing her complicity in the case, the film on her alleged life story will have no effect on the result of the investigation. CJM said that Court has failed to understand as to how, the release of film on the alleged life story of Anara Gupta is going to effect the investigation of the case. The question whether a particular film is to be allowed for public viewing or not to be determined by Central Board of Film Censorship. There is no provision in the code of criminal procedures, which empowers this Court to prohibit the respondents exhibiting the film in question on the grounds as stated in the application filed by SIT, if it is cleared for public viewing by Censor Board. The investigating agency is well advised to concentrate more on the job of investigation of the case, which has been entrusted to them, than in making applications, which do not further the cause of justice. Court dismissed the application with the observation that the probe in the matter has already been delayed and it needs to be speeded up.
