| Forest Magistrate sentences Bus Driver to two years imprisonment | | | Jammu, Feb 28 Forest Magistrate Jammu Mr. M R Chak decided a accident case, which took place in 1997 and convicted driver of bus Garib Dass to two years imprisonment with a fine of Rs.2000. Court also convicted accused u/s 279 RPC and sentenced him to undergo imprisonment for a period of three months and fine of Rs 1000.. Mr. Chak, after hearing Vandna Jamwal, PO appearing for the State and accused present in person, observed that statement of Suresh Kumar is so convincing as it leaves no scope for the accused to prove that he was not driving the bus rashly and negligently and did not hit the scooter as a result of which wife of Suresh Kumar lost her life. It is not the quantity rather quality of evidence which matters and Court has absolutely no reason to disbelieve the statement of the sole eye-witness. Preponderance of probabilities, driving of bus by the accused on the day of occurrence rashly and negligently, hitting the scooter, death of Arti and post-mortem conducted on the same day to prove the prosecution case beyond any reasonable, therefore, prosecution has proved its case and accused is held guilty of driving bus no JK02B-5907 rashly and negligently causing death of Arti on October 13, 1997 at Kangar Morh and is convicted and sentenced to under go two years imprisonment and fine of Rs 2000.
