CJM rejects bail of accused involved in kidnapping, rape

Chief Judicial Magistrate Jammu Mr. Sanjay Dhar dismissed bail application of Ghulam Rasool, who was arrested by the Ramgarh Police on January 14, 2007 in a case kidnapping and rape to a minor girl.
CJM, while rejecting the bail of accused after hearing CPO Mr. MA Manhas appearing for the police and counsel for the accused, observed that the prosecutrix in this case made a categorical statement before the police that she was subjected to rape by the accused and his two associates was wrongly confined her for two days thus there is sufficient material on record to implicate the accused/applicant in this case and referred the judgment of the Supreme Court and dismissed the bail application of the accused.
According to the police case the prosecutrix aged 16 years made a statement on January 5, 2007 alleging therein that on December 30, 2006 at about 9/10 A.M, she went to Gho-Brahmana from her house to get medicine for herself. The accused who is working as a servant in her house, met her, who was accompanied by his brothers Faqir Hussain and Saraj Din. The accused enquired about her health and than advised to take a tablet that will cure her pain. On taking the tablet she felt unconscious and was taken by all the three persons in a vehicle. When she regained her sense, she found herself inside a kacha house in a forest. The accused persons tied her arms and committed rape upon her. She was kept there for two days and on the third day when her father and other people came there while searching for her, the accused fled from the spot. On the basis of this statement of the prosecutirx, the Ramgarh police registered a case u/s 363/376/342 RPC and started investigation of the case.
