| HC issues warrants against ACS Home | | | Jammu, March 01 First Puisne Judge Nissar Ahmed Kakru of J &K High Court Jammu today issued bailable warrants against Additional Chief Secretary Home to procure his presence in a contempt case. These warrants have been issued in a contempt petition filed by Kewal Krishan against SD Mathur and Others. The Court had earlier directed the respondents to pay the interest due to the petitioner and file the compliance report within a period of six weeks, failing which Additional Chief Secretary Home Department shall appear in person. Though this order was passed on December 27 last but neither compliance report was filed nor the Additional Chief Secretary Home chose to appear, leaving no option for the Court but to procure his presence through bailable warrants in an amount of Rs 2000.. This Court direction has been passed in a contempt petition filed petitioner seeking initiation of contempt of Court proceedings against the respondents/ contemnors for disobeying the direction of the High Court passed on July 15, 2000 in which the High Court directed the rent assessing authority of Srinagar to make assessment of the rent within a specified period not later than two months from the date of authenticity of letter dated September 16, 1999 is verified. After the rent is assessed by the competent authority, the petitioner shall be paid the amount within 3 months. In case the rent is not so paid within the stipulated period, it shall be paid with 12% interest from the date of the order. In the contempt petition it has been submitted that the respondents have implemented partially the July 15, 2000 judgment and submitted that on July 4, 2005 an amount of Rs 1, 78, 065 only came to be paid to the petitioner and the interest at per the Court direction was not paid. |
