State High Court in a petition regarding allotment of land at Gulmarg, directed authority to furnish information regarding allotment cases of government land at Gulmarg, whatever in concis, showing the name of beneficiaries, the ground rent/premium/terms/tenure/date and duration of allotment made since 1990 along with mode and method of allotment, so that the matter could be considered
This direction has been passed at Srinagar by Justice Bashir Ahmed Kirmani in a writ petition filed by Ghulam Mohammed Bhat seeking direction to respondents for allotment order, and directed the Gulmarg Authority that the plot of land in question may not be allotted to anybody including petitioner, otherwise than in accordance with procedure established under law.
According to the petitioner’s case that he along with three other persons applied for allotment of land at Gulmarg for construction of hotels. The applications were processed by the respondents and possession of plots measuring one kanal each was given to all the four applicants, but while formal order of allotment was passed in respect of others, in case of the petitioner it was withheld with the promise that it would be issued afterwards. Feeling aggrieved, filed this petition seeking a direction to respondents for issuance of allotment order.
Justice Kirmani, after hearing Advocate Sajad vice MY Bhat appearing for the petitioner and Advocate SR Hussain appearing for the respondents, further observed that the advocate appearing for the respondents stated ordinarily allotments of this type are made after leasing out the land on auction, as such, the petitioner could not seek an outright allotment, perusal of records, however, does not reveal anything to suggest that any auction was intended or conducted in the matter, which renders the entire gamut of alleged transactions fishy and directed the authority to furnish information regarding allotment made since 1990.
