Consider case of petitioners, submit compliance report, HC

Jammu, March 04
Justice Hakim Imtiyaz Hussain of J &K High Court Jammu wing in the larger interest of drivers and cleaners of State Forest Corporation, issued notice to the Managing Director State Forest Corporation and others, returnable within two weeks and in the meanwhile directed respondents to consider the case of the petitioners for payments of TA/DA on the same analogy and is being paid to similarly circumstanced employees, including Jeep Drivers in terms of SRO 351 of January 22, 1998 and submit the compliance report within two weeks.
This Court direction was passed in a writ petition filed drivers and cleaners working in the J&K State Forest Corporation through Advocate WS Nargal in which the petitioners sought implementation of rate of TA/DA pursuant to SRO 351 dated December 12, 1998. In the petition it has been submitted that the corporation has adopted the rules promulgated by the state Government in toto with regard to the payment of TA/DA to various employees falling in a particular slab of pay-scale. That the payment of trip money to drivers and cleaners of SFC came enforced for the first time vide order No 97 of 2000 in pursuant to the alleged approval accorded by the Board of Directors in its meeting held on June 12, 2000 and the grant of TA/DA to the drivers and cleaners was dispensed with and the trip money/ night halt allowance was introduced for the first time. According to the order, the driver would get Rs.15 and cleaner Rs.12 as trip money cleaner the trip money outside the state the driver would get Rs 15 and cleaner Rs 12,out side the state while they would get respectively Rs.12 and Rs.10 within the state As such the drivers/cleaners were discriminated as the jeep-drivers of the corporation are getting TA/DA as per the SRO. The petitioners prayed for issuance various directions to the SFC and sought quashment of SFC order No 26/2006 dated February 2, 2006 coupled with addendum of August 21, 2006 and also seeking direction to the respondent to pay TA/DA to the petitioners in terms of SRO 351 dated December 22, 1998 on the same analogy as it is being paid to all the employees of the corporation including jeep-drivers and accordingly the arrears be also released with effect from 1998.
