| 3 narcotics smugglers acquitted as prosecution fails to prove | | | early times report Jammu, June 29: 2nd Additional Sessions Judge Jammu Subash C Gupta today acquitted three heroine smugglers namely Ved Parkash, Tarsem Singh @ Fouji and Tarsem Lal from whom six KG heroine was recovered following the prosecution has miserably failed to prove the case. After hearing both the sides observed 2nd Additional Sessions Judge Jammu Subash C Gupta that where there are contradictions in version of the official witnesses, corroboration from the independent witnesses is imperative in order to have just, fair and impartial justice. In the present case, it is totally lacking as independent witness namely jagdeep Singh has not supported the prosecution at all. Court after gone through the statements of the witnesses held that prosecution has miserably failed to prove the alleged recovery of Heroine from the possession of the accused and as such they are acquitted of the charges leveled against them. According to the police case on June 18, 2009 Police Station Khour has registered an FIR against Ved Parkash, Tarsem Singh @ Fouji and Tarsem Lal u/s 8/22/23/29 NDPS Act mentioning that at about 10:45 AM above said accused persons were intercepted while traveling on a motocycle during search 3 bags of 2KG each heroine was recovered and a challan was presented in the Court. |
