| Amarnath arrayed as accused in murder case | | | Jammu, Mar 06 1st Additional Sessions Judge Jammu Mr. GK Pandita today in a significant order arrayed Amarnath, as an accused along with accused Harmeet Singh, who is facing trial in a murder case for the last six years. This Court order was passed in an application filed by Additional Public Prosecutor Harpal Singh for impleading Amarnath as an accused in the murder case of Amarjeet Singh which took place on March 30, 2001 as the trial witnesses disclosed that Amarnath facilitated the act of the accused Harmeet Singh by catching and holding the victim Amarjeet Singh, the acts of the accused Harmeet Singh and Amarnath were brought to the notice. GK Pandita, after hearing both the sides, observed that in the present case which was instituted on May 29, 2001 while as the accused Harmeet Singh has been charged on July 4, 2002 and the prosecution was successful in producing its first witness only on April 5, 2004. On that day prosecution produced Suresh Kumar who was not an eye-witness while as other witness Surjeet Singh produced on May 28, 2004 soon after recording his statement, the State stepped in and moved an application for arraying Amarnath as an accused. On this Amarnath was put to notice for filling his objections. He filed his objections on July 10, 2005 and the application was kept for orders after arguments. In between, the Presiding officers were transferred; as such the order on the application could not be announced. The matter was brought to the notice of Court on August 30, 2006 and Amarnath was again put to notice for causing his appearance, as he had absented himself. Accordingly matter was heard a fresh. In view of the facts, which have come in the evidence of prosecution witnesses, there appear to be prima-facie compelling reasons for arraying the Amarnath as an accused side by the accused Harmeet Singh. Accordingly Amarnath is arrayed an accused along with accused Harmeet Singh to face the trial for the alleged commission of murder. The accused Amarnath who was present in the Court was taken in custody and sent to judicial lock-up. |
