Charges framed against Handloom employee

Special Judge Anticorruption Jammu Mr. JR Kotwal has framed charges against Tarsem Raj, who was posted as Cashier in the office of Assistant Director, Handloom, Kathua, in July 2002. Being a public servant he withdrew an amount of Rs 74369 from the government treasury on July 24, 2002 as GP Fund payable to Mohammed Din peon, but the accused misused of his official position, fraudulently misappropriated the said amount retained it for about one year and paid it to the peon on August 6, 2003.
Mr Kotwal, after hearing both the sides and perused the entire record. Upon perusal of the charge-sheet filed by Crime Branch Jammu and consideration on the record on file, he said the Court is satisfied that there is sufficient ground to presume that accused Tarsem Raj had committed offences u/s 5(2) r/w 5(1) (c) of PC Act and 409, 420 RPC and framed charges against the accused with the direction to prosecution to lead the evidence on the next date of hearing.
