DB issues directions to ERA, NBCC, JMC
PIL against unplanned digging, frequent traffic jams in Jammu

Jammu, Aug 16: In the larger interest of public, a PIL was filed by advocates Ashish Sharma and Deepak Singh Balouria against unplanned digging and frequent traffic jams in Jammu. They submitted that the entire process of digging of roads was mismanaged that the same were left dug up for months together with either little or no progress. Not only this, the roads where sewerage pipes had been laid, the agencies responsible for metalling the same were absolutely callous in the discharging duty. The Division Bench of State High Court comprising justice DS Thakur and justice Bansi Lal Bhat after hearing senior advocate BS Salathia with advocate Bhanu Singh Salathia for the PIL, advocate SS Nanda for the Jammu Municipal Corporation (JMC) and advocates Vishal Bharti and Ravinder Kumar Gupta for other respondents observed that while dealing with issue of macadamization of those roads where the process of laying down the sewerage pipes has since been completed by various executing agencies, directed NBCC and J&K ERA will file affidavits giving details of the roads where trunk sewer lines and lateral sewer lines have since been laid. "The said detail shall be reflected in meters/ kilometres ward wise/ locality wise. The authorities concerned shall also submit a detail regarding the date of completion of the works," the DB ordered. It directed that affidavits shall also be filed by PWD (R&B) and JMC as to what steps have been taken by them to ensure black topping of the roads where work has since been completed by the concerned agencies regarding laying down of sewerage lines. The DB directed the Divisional Commissioner Jammu to set up a committee which shall prepare a plan to ensure that all those roads where the sewerage pipes have been laid black trooping is also done preferably within a period of two months from today keeping in view of the rainy season. The court further directed all the authorities shall ensure that a report is prepared and submitted with regard to those roads where the sewer line were laid, black topping was also done but the roads have either given way or the black topping has since eroded due to use of inferior or sub-standard material or failure to meet the specifications as to enable this Court to take further action against the erring officers/officials and directed Registry to list this PIL after two weeks.
