Jammu, Aug 16 : Principal Sessions Judge Jammu Kartar Singh acquitted Jasbir Singh an army solider who was facing charges for murder of his wife as prosecution failed to prove its case. According to the police on 7 April 2008 information was received from reliable source that the accused Jasbir Singh, came to his house with an intention to murder his wife Chinta Devi and inflicted injuries on her face, neck and head with a khokhri, as a result of which she sustained grievous injuries and was taken to the hospital. On this information, FIR for the commission of offence falling u/s 307 RPC read with section 4/25 Arms Act was registered. Later she succumbed to the injuries. The Court after hearing advocate O P Sharma for the accused and PP Shabir Choudhary for the state observed that the statement of the accused was recorded under the provisions of section 342 Cr.P.C in which he has taken a defence that on the day of the occurrence he was not at home and had gone to Pathankot in connection with his temporary duty. The court observed that the prosecution has miserably failed to prove its case against the accused beyond any reasonable shadow of doubt. "The circumstances relied upon by the prosecution connecting the accused with the commission of the alleged offence have not completed the chain, so as to exclude the innocence of the accused. With these words of pain and sorrow for the deceased, the court is left with no other alternative except to acquit the accused, who is therefore, acquitted of the charge framed against him," the court ordered.
