| CJM grants15 days judicial remand to two accused | | Chopra murder case | | Jammu, March 09 Chief Judicial Magistrate Jammu Mr. Sanjay Dhar today granted 15 days judicial remand to accused Mahesh and Rushi real brothers resident of Village Khaijara Chack, District, Gunna (MP) who were arrested by the police in connection much publicized Chopra murder case. The accused were produced in the Court in custody through SHO along with case dairy. Accused were arrested on January 6 last in connection with FIR 107/2006 u/s 302 RPC. CJM in the order observed that accused were arrested on January 6, 2007 and have already spent 60 days in police/judicial custody pursuant to orders of remand passed by the competent Courts from time to time proviso “a” to sub-section 2 of 167 CrPC, gives indefeasible right to the accused for grant of bail upon the expiry of period of 60 days in custody. However, before such right comes into effect, accused has to be prepared to furnish bail and thereafter he has to furnish bail to the satisfaction of the Magistrate, only then accused can avail this right. In this case accused have not made any application either oral or in writing for grant of bail. In fact Court asked the accused whether they are prepared to furnish bail, but they have stated they are not prepared to do so. In these circumstances Court is left with no alternative but to remand the accused to judicial custody for a period of 15 days. On the expiry of the period of remand, the accused be produced before the competent magistrate. With these observations Court granted judicial remand to the accused for 15 days. JNF
