Seminar on “Whither Criminal Justice System” held in HC premises

As a part of Diamond Jubilee celebrations of Jammu and Kashmir High Court, a seminar on “Whither Criminal Justice System” held in the High Court Complex here today. Judge of the Supreme Court Mr. Justice Arijit Pasayat chaired the function and Chief Justice of Jammu and Kashmir High Court Mr. Justice B.A.Khan co-chaired the function. Another Supreme Court Judge Mr. Justice Dalveer Bhandari was guest of honour and country’s noted lawyers Mr. Ram Jethmalani and Mr. K.T.S.Tulsi were guest speakers of the function.
Most of the speakers threw light on the Criminal Justice System in the country and stressed the need for strengthening the trial courts for speedy and quality justice to the needy with greater degree of credibility.
In his address, the Chief Guest Mr. Justice Pasayat said that there is nothing wrong with the criminal justice system of the country but approach could be differ, “we have to make our best efforts to bring the crime rate down with some unprecedented reforms in our system”, said Justice Pasayat. He shared his experience with the audience.
Justice Bhandari underlined the need for certain reforms to improve the existing laws as per world scenario. With the changing environment, law luminaries have to acquire legal education in new areas, which are emerging day-by-day. This will help in the justice delivery system more effectively. He also stressed the need for imparting quality education to students in the law institutions of the country as per latest trends.
Mr. Ram Jethmalani expressed his concern for growing intervention of politics in the judiciary for various reasons. He said that judiciary is an independent body and it should be free from all kind of intervention. He identified certain areas of improvement for better delivery of justice. He said that every lawyer should keep in mind his ethical duties and work fearlessly without any influence to provide justice to the innocent. He rubbished the ideas that Indian Penal Code has become outdated and said that there is no fault with the law but fault is with the system, which needs to be improved. There is no need to tinker with the existing laws, said Mr. Jethmalani. He also gave few tips to the young lawyers for restorative justice to the needy. He shared his vast experience with them.
Justice B.A. Khan while enlightening on the Criminal Justice System briefed the audience about the history of Jammu and Kashmir High Court. He said that Jammu and Kashmir High Court is one of the best Court in the country and various reformative measures have been taken in recent past to make the justice delivery system more effective. He also appreciated the attitude of Bars of various courts.
Justice Khan thanked the visiting dignitaries who spared their valuable time and graced this historical event of valedictory function, which has been organized in connection with the Diamond Jubilee celebrations of J&K High Court.
Judge of Jammu and Kashmir High Court Mr. Nirmal Singh,Senior Lawyer of Supreme Court Mr. K.T.S.Tulsi, President of Jammu Bar Association Mr. Ved Raj Wazir, senior lawyers Mr. D.C.Raina and Mr. U.K.Jalali also addressed the audience and shared their experiences.
Among others, Finance & Parliamentary Affairs Minister Mr. Tariq Hameed Karra, Chief Justices of Sikkim, Orissa High Courts, senior Judge of Andhara Pradesh High Court Justice Mr. Billal Nazki, present and former judges of State, judicial executives and legal fraternity and disguised guests were present on the occasion.
